I had a buyer (NOT a forum member) fail the background check on a purchase. I don?t have the details but the ffl called me to say the buyer, someone he knew, failed. The deal was to be completed upon passing obviously. The buyer gave me a sizable deposit which I returned.
Seemed legit, he said he was going to appeal. Just an awkward meeting to say the least. Have any of you run into something similar?
Should taken full payment up front.
They fail, not your problem. The FFL has a free gun in his inventory.
Your not the one who was denied so why is it your problem?

That is one of the reasons why I have been selling on consignment, it lets the shop deal with hiccups like this.

Seems to me that if he gave you a deposit rather than payment in full, he probably knew there was a chance he would be denied
Right, it was awkward because the guy was very apologetic-he’s a professional (doesn’t mean something isn’t off in his history)-kept apologizing, said he didn’t understand why he got denied. Yes I know it happens mistakenly as well as legitimately. We had a great chat leading up to the purchase, it’s a fairly expensive 1911 and he definitely knows his firearms.
I agreed to take the deposit because I got a good feeling from him. It’s the first gun he was buying post divorce so maybe there’s something there that needs to cleared.
I like to believe I’m good at reading people, has served me well in my various careers and never got the feeling something was off.

so, did you get the firearm back? Or are you going to leave it with the FFL to see if this guy's appeal is successful?
CBI appeals are taking at least 90 days now
Yes I got it back, I'm reposting it here actually.
I had a similar situation, but it was before the 4-6 day CBI mess we have today. We waited at the FFL's home, when he failed, he paid the FFL for the background check and we parted ways. He did end up getting it fixed, something to do w/a prior DUI that the paperwork had gotten messed up (or something like that). Sold the pistol to the next buyer.
I also had a buyer recently (last 6 months) who was here w/a green card - her check took a bit longer, but the FFL (awesome guy BTW), held the gun and the cash for us, transferred the gun to her when she passed, and held my cash for me until I could get back. Can't say enough good things about that FFL!
I'm wondering these days of the liberal anti-gun political "elite" here in Colorado aren't somehow influencing this "slow-down". Maybe it's "tin-hat paranoia", but with all the BS going on from the WH with the imposter "Slowjob" Biden, I wouldn't put it past the sheep here to follow that lead. I just find it hard to believe people are still buying at the accelerated rate they were several months ago, but I could be wrong.

Ok...so during the Clintons they tried pulling a stunt where they told the feds to deny purchases. If you didn't appeal you would end up permanently denied. At that time I decided to by a .50DE. Went and bought from Paladin Arms which had moved from Boulder to Longmont. They did the background check and it came back with a 24 hour delay. Called the next day to find it had changed to a 3 day delay. Called back 3 days later and it had been changed to denied. There was zero reason for a denial on me. They said to come up and get my money back and they had a form to appeal the denial. That paperwork stated specifically if I didn't appeal I would be permanently denied. It also stated that either way I would receive in writing the reason behind the denial. I filled out the papers and sent them in. A month later I got a call from Paladin and they had received an all clear for me to come collect the gun. I went up and they took payment and I left with the gun. I have purchased numerous firearms since without a hiccup. It was a few years later that I heard about the Clintons trying to get people added to the denied list by this method.
I never received anything in any way that stated why I had been denied. The only response was their call to Paladin approving the sale.
Your buyer may be legitimately innocent in this and his embarrassment may be genuine and deserved. I know I was certainly embarrassed when it happened to me. I felt embarrassment even after having been cleared. The employees seemed to act oddly when I went back to get the gun. It was possibly just my perception or they may have felt odd that I had been denied to begin with. Don't know. I do know it was pretty uncomfortable. They asked what I might have done to be denied both when it came back as denied as well as after being approved as if even tho I was cleared I was still somehow guilty of something.
I was denied once. Apparently if your driver?s license expires then you no longer have a valid form of identification so they deny you.
Renewed the stupid thing and everything went fine.
I used the electronic form at centennial the other day, and it makes you put in a email address? At first I left it blank for many reasons, but it wouldn?t let me proceed until I put one in. When did that start happening? You have to have an email address to buy a gun?

Place like Boulder, people do get a parking ticket even if you are 30 second late. I've seen parking enforcement officer issuing ticket (in the 90s) 2 minutes before meter expired too.

Few stores said that it is upto the buyer and the store to arrange a transfer (re-do background, or sell it to different places). Basically, those few stores said it is between Buyer and FFL issue. Seller gets paid.
Majority of stores was saying that I need to get the firearm back after doing background check on my own firearm. :(
FTR, people who advocate taking money up front and letting them deal with it fail to realize that is a HUGE asshole move to the dealer.
You go to the dealer to transfer your gun from party A to party B. If the dealer is following all the advice on private party transfers, they are not filling out firearm info and if denied, your weapon has not been entered into their books at all.
So for a presumptuous customer to say "Whelp dealer, its your problem now, you are obligated to sell it on your shelf and fight with this guy who wants his money back"
....
I know a few dealers who would tell such a customer how far a fist can be shoved up a butt. Not attacking anyone here, just remember that when you are doing a private party transfer, everyone - please don't be a dick to the dealer.
Well said FoxtArt. It sucks as a dealer having to resell someone else’s gun if they can’t pass CBI. The amount of emails, phone calls, lowball Armslist offers for a gun that you’re not making profit on is hardly worth your time. I’m still trying to sell a couple guns where the buyers couldn’t pass CBI. It’s part of the game.
