JEFFERSON COUNTY, Colo. -- An illegal immigrant accused of felony theft will not stand trial. Instead, he was given the chance to go home to Mexico.

Damacio Torres-Ochoa, was scheduled in court Monday afternoon in Jefferson County to face charges of theft from an at-risk adult. But Torres-Ochoa never showed up in court. He was in Mexico.

"He self deports," said Scott Storey, Jefferson County District Attorney. "He says, 'You know what, I am illegally here, I don't want to fight it, get rid of me.' So what happens? They take him across the border. Do you think he comes back? Well my guess is he comes back and he comes back under another alias and we haven't got justice here."

Storey is outraged Torres-Ochoa was allowed to self-deport.

Storey said Torres-Ochoa bonded out of the Jefferson County Jail on Oct. 4. He was not allowed to leave, because Immigration and Customs Enforcement had placed a hold on him. Storey said on Oct. 6 ICE officials picked up Torres-Ochoa and on Oct. 19, Torres-Ochoa was flown to El Paso, Texas and walked across the border.

Robert Wallace, the victim in this case learned of the deportation during the court hearing Monday.

"Some of it does not make any sense at all," said Wallace.

Storey said Torres-Ochoa drove the truck which was hooked up to Wallace's trailer when it was stolen.

"I don't know what to think," said Wallace, confused.

Torres-Ochoa faced 12 years behind bars for the crime.

"If a person can self-deport without any consequences, you are treating him better than you are our own citizens," said Storey.

Wallace pleaded guilty in September to shooting at Damacio Torres-Ochoa and Alvaro Cardona while they were stealing the trailer. Cardona was shot in the head and suffered severe injuries. Wallace was sentenced to two years of probation for the shooting. He is now a convicted felon.

"I sat down and apologized to (Wallace)," said Storey, explaining how he said it was unfair Wallace had to face the consequences for his actions, yet Torres-Ochoa did not.

Storey said laws need to be changed to make sure something like this can't happen.

"When you have charges, felony charges, class 3 felony charges, that we are prosecuting, that have not come all the way through the system (ICE) should be precluded from deporting (the suspect)," said Storey.

Storey said there is no law that requires immigration officials to keep an illegal immigrant in the country to face charges.

"It is almost like (ICE is) implicit in him escaping from justice," said Storey.

Storey said this entire thing would not be an issue had the judge, Thomas Vance, not reduced Torres-Ochoa's bond from $100,000 to $27,500.

"Thomas Vance knew he was an illegal because of the fact I had it on the paperwork," said Storey. "Yet he found it necessary to reduce it to $27,500."

Storey said he sent the chief county and district judges letters asking them to keep bonds high on known illegal immigrants because of their flight risk.

"It is a frequent problem that we local district attorney's face and it has got to stop," said Storey.

Torres-Ochoa used Reliable Bail Bonds to secure his bond.

7NEWS contacted Rosalie Montoya of Reliable Bail Bonds who said she will now apply for exoneration of forfeiture.

In 2007, the Colorado legislature passed a law that states if a bail bondsman secures a bond for a person who later turns out to be an illegal immigrant, the bondsman can get the bond back, minus the fee charged.

Montoya said the fee in this case was $2,750 for the $27,500 bond. Torres-Ochoa's sister also put up her house as collateral.

Montoya said she expects to gets everything back minus the $2,750. If for some reason she does not get the money back, she said she then has the right to go over Torres-Ochoa's sister's house.

Tuesday, an arrest warrant was issued for Torres-Ochoa. His bond, if arrested will be $250,000 cash.

There are some misconceptions here.

First off, there is no legal term such as "self-deport." There are the terms Voluntary Return, and Stipulated Removal and removed or deported (assuming that he has never been deported before).

A VR only takes a seat on the plane (once he signs admitting that he is in the US illegally). But, I pretty much guarantee that he wasn't VR'd...it would be against Denver ICE policy do do so, for a criminal alien.

A Stipulated Removal is when the guy accepts a formal removal to Mexico, instead of being ordered removed by a judge. This takes 7-10 days...instead of 30 (guess what probably happened). But, both of the last two removals count the same and being as he was ordered deported he'll never get amnesty or other benefits. He has to apply for permission from the Attorney General, w/in 5 years to LEGALLY re-enter the US (There is no obligation to apply, if he is going to enter the US illegally).

Storey only told half of the truth....ICE is under no legal obligation to hold the guy for trial...but they do have a legal obligation to follow due process of law and put, and keep the guy in removal proceedings (there is a legal process that has to be followed after all, you didn't actually think that ICE could actually hold him w/o bond indefinitly did you? He does have rights, doesn't he?).

I bet you dollars to donuts that Storey knew that the guy bonded out and did nothing to get his bond changed. So, DAs try to get em back and some don't.

Now, my guess is that Storey knew that the would be back soon (You don't actually think that he is telling everything that he knows about the case do you?). Anyways, once the guy is nabbed again, they will be a warrant for the guy and his stuff will look awfully weak the next time that he is in front of a judge...and you know....a leopard can't change his spots. He'll be arrested again, for some Mickey-mouse offense and his prints will pop up in AFIS (look it up).

My guess is that the alien was in jail for awhile and was desperate to get out and is crazy enough to believe that they won't look for him. So, he'll just come right back.

There was an ICE hold on him...they knew his citizenship. Also, no fed law against verifying citizenship. In some places...sanctuary cities, they don't do it.

Okay, I'm not a bail bondman, but this CO law that let's them off the hook for the bail on an illegal just means they'll keep bailing out illegals. If he had remained in jail ICE would have had to jump through some hoops to help him run from justice.

Dang Byte, that pisses me off just reading it. This type of abuse has got to be stopped. Why can't we get some common sense laws in place and common sense public assistance like welfare in place? I realize that some folks legitimately come on hard times so I'm not advocating completely doing away with the program, but Food Stamps should be run like WIC where you can only buy certain types of food - and it must be nutritional, not junk food. You want junk food, get a job that'll pay for it. And niceties like steak should be coded as a very limited item.

When I was in college and couldn't even afford a bike to help me get around town - and got $0.00 support from my parents or anyone else, I stood in line at the local Safeway with the barest of essentials that I could afford and carry the 1.5 miles to my roach infested trailer. I watched with envy the guy in front of me with his new Reebok's and leather Members Only jacket (it was the '80's and they were in style), and all of the wonderful food he had. He paid for it all with Food Stamps. I was furious. I then watched him go out to his car, it was a less than 2 year old Trans Am, knowing that I was going to have to carry my pitiful purchases by hand all of the way home. At that point, I came to realize just how fraught with fraud and abuse the welfare system is. Not that it really makes it any better, but at least that guy was a citizen.

Why is it that our government thinks we need to give special privlidges to illegal non-citizens anyway? As much as I hate to say it, even under Conservative administrations we were making it easy on illegals. None of these problems we're reading about in the news today is a new problem - they've only become increasingly worse recently, that's all. So, why?!

Aside from basic human rights, I say NO, there shouldn't be any. The rights should be for citizens, just as I firmly believe that the Constitution only applies to citizens. Just the way I feel!

Sadly, I think that this would just throw our government into high gear to offer amnesty and remove the "criminal"/"illegal" aspect of coming into the country illegally so as to prevent another lawsuit of that nature.

I have to say that I do agree with you. I often seen food stamps being used and then a cart full of other things that are purchased with cash because it is obviously something that food stamps do not cover. Which generally pisses me off because they are luxury items like candy and cigarettes and what not (I actually never pay close enough attention and I know that I should).

I am a little torn about helping illegals because we want people that are in our country to be healthy too right? We don't want them starving and getting diseases to pass on to all of us and to commit even more crimes because they are hungry. Then I go back and say, well they are immigrants, they shouldn't even be coming here unless 1. They are legal 2. They have a job lined up, or 3. If they have no job they have some sort of support system. Then I go back again and say, well lets be realistic, that is ridiculous to think that illegals are not coming over here without those things.

I don't know, food for thought. Happy to hear your thoughts.

The crack reporting staff at the Post decided to run this story today, two days after it broke. I'm sure the timing of this story in the post and the elections are coincidental . The judge (Vance that reduced the Bail from $100,000 to $27000 was up for retention. There was a Bail Bonds prop on the ballet, and of course Tancredo and his immigration reform stance.
