I'm not sure who here is familiar with Larimer county Sheriff Justin Smith, but he's one of the good guys. He's been extremely vocal and politically active during these last few months and posts regularly on facebook. His comments line up 100% with the consensus we have on this forum. Here is his response to this concern:
"Several citizens have contacted me expressing concerns about an article they read reporting Colorado granting state law enforcement authority to the Secret Service.
I am aware of this and the stories that you've likely read put this in a light that isn't truly accurate. Let me give you some background.
Several years back, local law enforcement recognized that the way our peace officer statutes were written, federal law enforcement officers working in our state had no authority or legal protections to intervene when they witnessed a citizen being victimized right in front of them. Their statutory authority only allowed them to intervene if a federal law was being violated. Very few daily crimes are federal violations. (Envision an Aurora Theater Shooting incident where an armed federal officer had no statutory authority to intervene as a peace officer).
Our state Police Officers Standards and Training (POST) Board, made up of Colorado Chiefs and Sheriffs, agreed to consider requests by individual federal law enforcement agencies to grant limited powers to their officers, in the interest of immediate protection of Colorado citizens.
The changes essentially allow those officers to intervene when they witness a crime in progress and require they turn the case over the to the local authority. They also are granted the authority to assist a local officer in need. Lastly, the statute specifically prohibits the covered federal agencies from initiating any independent investigations of state law.
If you would like to read the specific wording of the current statute, it is CRS 16-2.5-147. This year's amendment simply adds agents of the Secret Service to the list of officers that we recognize under Colorado statute."

We have enough local county, city and state law enforcement. Giving more power to federal agents is asking for more overstepping. The worse part is secret service was listed as the subject matter. Outside of protecting Federal elected elite, and watching over the mint what do they need to be doing that the other law enforment is already doing.

There are Mint police, Secret Service Agents, ICE Agents, DEA Agents, ATF Agents, HUD Agents, DOE Agents, IRS Agents, Federal Park Rangers and a number of other law enforcement associated with the IG units of all the federal agencies. You would be surprised at how many different types of federal law enforcement that are here in the Denver area.
Like you said earlier- anywhere a USSS protected individual would go (aside from the multitude of smaller, temporarily protected individuals, mostly dignitaries) be it the POTUS, VP, or SotH, there will be ample local LE presence and really the only crime secret service would happen to be there for would be an attempt on the life of a protected individual (P, VP, Speaker- all attempts are in violation of Federal law). No need whatsoever for more powers.
[blah-blah] Of all the things to get upset about, this is right down there on the bottom of the list. The way jurisdiction works for arrest authority is enough to require a multiple page thread to explain for the various Fed agencies. Hell, for military Feds it's so confusing I've had to call two different attorneys before detaining someone before. Its a complete mess, and most Feds just call the local LE and stay out of it.
Bet most of you complaining about this would be seeing red and wanting to crap fire if some USSS agent stood by and watched your wife get assaulted, beat, mugged... because they didn't have any arrest authority. It's happened, and it's happened here in CO before. May have not been Secret Service specifically, but I've seen it happen with military feds a lot. No arrest authority, Posse Comititus (sp)... Just safer for the agent to stand by and watch short of life or limb threat.

Yeah, that is true. The article was specifically about the Secret Service. There is another bill running through the legislature right now to give the DoD cops at Fort Carson state police powers as well. In the statute, other federal Agents have been given state police powers already. It really is a non-issue, but I would be hard pressed to convince you of that.
I would wholeheartedly agree there is too many federal employees and too many federal law enforcement under each of the IG offices of EVERY federal agency. They need to consolidate and shrink or require the FBI to take over their investigative duties without an increase in manpower and do away with the IG offices. I agree completely. Is it going to happen? No.

I guess I'm still old fashioned enough to think Law Enforcement are the good guys. I may not agree with the laws, and there are ways to change them. I might not agree with the methods, there are ways to change that as well. I've been all the way around the world, and my impression is most people just have No. Freaking. Clue. how good we have it with our police forces; Federal, State, and Local.
They said the same thing in Germany in the 1930s. Just because its the feds, that does not make it right, or good. Germany did not go socialist/nazi overnight. It happened in steps.

Clearly Sheriff Maketa does not understand why this is even being proposed, and that seems to me to be the key here. The answer to that question may either comfort or alarm people. However, until that question is answered, I personally can't blame regular citizens from being concerned about this bill. I don't really consider that tinfoiley at all given what we have seen so far from this administration and justice dept.
I think one of the problems is when people who are experienced and educated on these issues post their comments they get flamed if that answer doesn't coincide with the topics political climate. Speaking for myself I am a 22 yr. LE veteran and retired as Chief of Police. Through the years I've had to work with the Fed.s on numerous occasions and the majority have very little knowledge, or desire, on the enforcement of State and local laws. My considered opinion is this is unnecessary legislation. There are not enough circumstances to warrant legislation like this. I think that is why many folks here are skeptical as to the reasons for it. Add to that the timing of it and the fact that we just had unnecessary restrictions put on honest citizens, ie; mag. Capacity bans, background checks etc... And one can see why conspiracy theories abound.

Tinfoil aside, I don't think that it is completely irrational to initially respond to ANY legislation with scrutiny as we have been/are being inundated with stupid legislation at both the state and national level.
I have not read through this entire thread, but at this point I'm still concerned about the ramifications of the 72 hour mental health hold.
