They know this is going to die, so this is a last ditch attempt to keep it alive. Kind of a "line item veto" in reverse. The executive order is what he tried first and admitted that was as far as he could legally go.

Except all he needs is a something that allows declaration of marshal law ...say like a food shortage, act of terrorism (which currently has a vacillating definition), executive branch has so many powers at the moment once criteria X,Y, and Z are met.

People will accept it open arms, and realize way too late it was a huge mistake.

He can try an executive order and have the BATF impose additional restrictions. He won't care if it holds up in court a year or two later.
