    "Since a frame or receiver for a firearm, to include one that can only be made into a long gun, is a "firearm other than a shotgun or rifle", it cannot be transferred to anyone under the age of 21."

    No, besides the barrel... (Which a lower does not have) the major part that makes an AR a rifle or pistol is the use of a stock.... Which is attached to the lower. Simply look at the NFA rules on what makes an SBR. This becomes very clear because they layout where you have a pistol (legal to own with say a 10" barrel or only a buffer tube) and a rifle (stock, foregrip, 16"+ barrel, overal length of 26"). Of all of these the stock is the only thing the lower is a singular part of the equation. If it has a stock, it is either a rifle or an SBR.

    I think what we are ALL tripping over are the inconsistencies of the ATF rules, where an AR is concerned. Your friend can buy the exact same part (if we are talking about just the lower, the stock makes it a rifle at the point of sale) and depending on what somebody calls it determines if he can have it or not regardless of his true intent once it leaves the store. It makes no since when I can make a legal lower illegal with a simple 30 sec change of a part like an upper but thems the rules. The guys at Cabela's screwed up and could have worked with the guy to figure it out but did not. This is the difference between big chains and small shops. If you go into a big chain and know what you are looking for, many times you can come out ahead. They do bulk much better than a small shop can... usually. If you are looking for knowledgeable people with better customer service a small shop like Bowers or Ark are better... usually. I have had zero problems with either of these shops or others when I need help that larger chains just scratch their head over. End of story, your friend would have been better served with a smaller shop in this instance.

    They are correct as is Cabelas.
    I just dug out a 4473 and it does confirm what they stated.
    Thinking about it a bit more the ATF made some changes to the "Other" category around 2008-9 which slammed the door on firearms in the category of "Other" being sold to the 18-21 crowd.
    That was right about the time I left a retail shop so I never had to deal with it.

    Gentlemen, I apologize for the incorrect information.

    Now I shall go to the jackyard and backoff in shame......

    ok, just to be clear. If you are under 21 you are not allowed to buy an AR lower (even if fully built or has a stock) unless it is accompanied by a Rifle upper? Not arguing, just getting clarification.

    That's the way I read it. No receivers/lowers under 21. Must be a completed rifle only.

    Now why did you have to go and do that? There you go again using facts and actually reading the directions... Now the real question is: why do you have a 4473 handy? I thought you were outta the FFL game?

    But if it's a complete AR, then they could right? It's only because it's a receiver only? I guess I understand the rule, but not the gist. And I still swear I've seen it talked about others in the under 21 boat picking up stuff like that.


    So if he's got the rest of the rifle built out except for the lower, he's stuck till 21 if he's playing it by the book then?
