    Acting like a fake gun is real falls into the "felony menacing" category. If the cops believed it to be a real gun and this guy didn't drop it or comply, then it's probably a justified shoot.

    Maybe one shot in the knee by one officer. No need to shoot to kill unless the gun is pointed at an officer or other person.
