    These types of criminal laws are one of the ways we end up with 83 count indictments. Sometimes they are what are called "lesser included crimes." When the prosecutor can't get the full charge proven before a jury, they have a fall back position.

    Most often, these types of charges are used as leverage during plea negotiations before trial. Between the charges a prosecutor can drop and the points off on the sentencing guideline, there is a great incentive for defendants to plead rather than go to trial. This is a major reason why so many cases never go to trial in the federal system.

    My guess is the federal case in Tucson will all be decided on how badly the US Attorney's Office wants the death penalty for Loughner. If the needle is taken off the table, this case won't go to trial. IMO

    I've never gone to an ivy league school but last time I Checked, Illegal things we already against the law.

    This is just another way for them to attack free speech. The idea is not that it is already illegal to legitimately threaten someone, but now they want to include everything that THEY fell is threatening to them as a crime. This way it will actually be an indictable crime, or better yet probable cause to gain things like search warrants on us gun toting right wing extremists. Watch what you post because God forbid some crazy a hole goes out and commits a crime, and now you are an accomplice.
