Kudos to the biz and customers.Police notes: Man arrested on outstanding warrants while trying to purchase weapon
By Beacon staff • January 27, 2011
Andrew Alvin Fracsh, 39, of Windsor, was arrested on Jan. 7 for assaulting an officer, resisting arrest and having outstanding warrants.
Windsor police were contacted by a local business at 1:57 p.m. in the 1200 block of Main Street for an individual, Fracsh, with active warrants attempting to purchase a weapon. When the business sent Fracsh's background check to the State of Colorado, the Colorado Bureau of Investigations contacted Windsor police to notify them of his warrants.
Two officers responded to the location, but were informed Fracsh had left but would return. When Fracsh did return, an officer approached him and advised him he was under arrest.
As the officer was gathering his handcuffs to place on him, Fracsh pulled away and grabbed the officer. The officer pushed him back, but Fracsh charged at the officer and grabbed his leg, knocking him down.
One of the business' customers grabbed Fracsh's arm, but he was still unwilling to release the officer. The officer grabbed his Taser and again ordered Fracsh to place his arms behind his back. When Fracsh refused, the officer tased the back of his neck, at which point Fracsh complied.
Fracsh was verbally combative and advised the officer he had defecated on himself. He was taken to the Weld County Jail.

The officer grabbed his Taser and again ordered Fracsh to place his arms behind his back. When Fracsh refused, the officer tased the back of his neck, at which point Fracsh complied.

Wow, one guy busted ... that was sure worth the millions of dollars the "instant" check costs an the thousands of honest people denied free and unencumbered exercise of their constitutional rights!
Yay Bureaucracy!

I bet he did. When Fracsh refused, the officer tased the back of his neck, at which point Fracsh complied.
Sounds reasonable.Fracsh was verbally combative and advised the officer he had defecated on himself.
I had at least 3 people arrested in my store during the course of waiting for background checks. All warrants...all really minor stuff.
I had a deputy call me once and ask, "Is so-and-so in your store buying a gun?" I told her he was there and had his 2 kids with him. She replied, "I'll be there in about 3 mins. He needs to be gone before I get there."
I "advised" the customer it was time to gather his flock and leave. He did. Deputy arrived and told me he had a Dog at Large warrant. Hardened criminal, that guy. I called him later and told him to pay his ticket. He did and returned and bought the gun later.

Don't wanna get shot by the police?
"Stop Resisting Arrest!"
FWIW- this is not that uncommon. When I worked in the shop we would average about 2 a year that got the cuffs. Never had anybody get combative but rather the classic "What? Me?"
Really? You didn't know you had a felony warrant for distribution of a controlled substance?
You didn't know you had a felony warrant for 2 counts of assault?
I understand how it would be easy to overlook minor issues like that.
We did have a couple that they carted the male half away and the next week the female half came in and tried to buy the same pistol. The shop owners recognized her and refused to sell it to her. She got rather indignant when I explained the concept of a "Straw Purchase" and finally left when we had to threaten to call the cops on her.
