I don't necessarily think the guy should be charged with a crime but there is no doubt that he has to pay all of the money back. Just because someone else made a mistake doesn't mean that he gets to profit from it.
That would a a different dilemma entirely. You have an unmarked garbage bag filled with money in your front lawn.
Personally I would not spend a dime. Namely due to this guy showing up shortly to collect it.
