Anything over the $5,000 can then be covered by the other driver's Bodily Injury Liability coverage. However, you don't just send bills to the other insurance company with the expectation that they will directly pay the bills. They will not settle with you until you are done treating. After you are done, and all the bills have been collected, they will offer you a settlement amount. Medpay is also non-subrogable in Colorado.

Don't let this post freighten you though, as I was just trying to be clear on the difference between Medpay and BI Liability. I would not expect your injuries to come anywhere near $5,000, if that happens to be your Medpay limit. $5,000 Medpay is the most common level of Medpay coverage that I see in Colorado. Glad Everyone is okay.

Adjusters and agents often end up at ends with each other because even though they are dealing with the same product, where they actually operate is vastly different. "How will this affect my rates?!" "Hell if I know, call your agent."

"The sun was in my eyes". Same excuse a driver who killed a friend of mine who worked for the Aurora Fire Department said. That battle is still being wagered in court. I understand the sun was on the horizon but I still find that excuse to be lame and hogwash. That's what visors and sun glasses are for. I think most of us here have driven for a long damn time and never hit anyone while driving with the sun in our eyes. I agree with a previous post, jack-hole was probably on his cell phone. Don't feel bad about giving that guy the bird, he probably deserved it. Glad you are just a bit sore and nothing worse. Even more glad your little one is okay. I have been taking light rail into work a lot lately and I find when I do drive on my days off I get even more enraged at the stupidity that clogs our roadways.

My wife worked with a young lady once, she had a young son. Her and her son were very close to her mother. One day her son was out with Grandma for some good times, and they were sitting at a red light chatting. A drunk driver came screeching around the corner from the cross-street on her left and slammed into Grandma's door, killing her instantly. The boy wasn't hurt, but imagine the memory burned into his poor little brain of his last visions of his beloved Grandma. That family was devastated. An innocent life snuffed and a young boy's innocence snatched from him in an instant without warning.

I handle a lot of accidents in that area. Basically from about 92nd to 136th, and Huron to Washington. Nice little Bermuda Rectangle of intersection accidents.
