Well, keep in mind that the cake wasnt a completed transaction at the time the baker refused to do it. Payment and contract were not in place. Here we are talking about existing service, with terms of service that has been paid. So a little different. Remember, the people the ISPs are cutting off are not doing anything recently that they werent doing before when it was supposedly ok.
I would also agree with a previous post that the ISP is more aligned with the idea of a utility. We haven't grouped them into the utility industry probably because the internet is new and rapidly changing and it takes someone to challenge things in court for laws to change. This may be event that pushes ISPs into a different realm of service responsibility.
