Got my confirmation for my free can as well this week. Now to wait another four months before they process/ship it.

Which is horseshit that they are ending up taking about as long as the actual fking NFA submission.

Does anyone ever check to see the status? Is it even worth it? I had an sbr through kiosk submitted in January and got it back like June then submitted a sbs in February and nothing yet. Just wanted to make sure everything is in process I know each case is completely different.

Yes, I have called them on a couple items
. They basically will only tell you if it is pending or not. Will tell you the timeframe of applications they are working on, but that is all I could get from them.

I have been told several things when calling for status check. When you call you get a clerk type person that is getting information from their computer. You do not talk to a person actually processing Forms. The status person can tell that it has been received, if it is pending, if it approved, if it is approved pending correction, if it has been sent to be mailed out as approved or sent for correction. They can give you dates for those things. They can tell you all those things if it is in the computer. They can also tell you how to get a Official Copy of an Approved Form that they show as being Approved and mailed 3 months ago. They can answer some other procedural questions too. Talking to these guys does not interrupt the flow of processing the Forms.

Anything else they can transfer your call to someone that is actually working on processing the Forms. It can be someone handling your specific Form or someone not handling your Form. I think the processor people are called Examiners. Talking to an Examiner takes their time away from processing forms.

The last time I called them was about 2 years ago so this may all be out of date.

eforms (form 1) is back online...

Still have to mail in prints, and upload scanned (signed) RPQ's. Prints have to be mailed with the cover sheet form the application within 10 days of filing online.

Haven't really dug into it - I had one still in draft I never submitted.

Seems a bit of a hassle over just mailing the damn things.


Special Instructions for Individuals, Trusts and Legal Entities
FILING AS AN INDIVIDUAL

The applicant must attach a digital photo in the Photo function on the Responsible Person tab.
The applicant must also provide his or her fingerprints on Form FD-258. The fingerprints will be submitted separately from the application. Upon submission of the application, the eForms system will email a cover sheet to the applicant. The cover sheet is to be printed as it will provide the control number of the transaction and the address where to send the fingerprint cards. The cover sheet and fingerprint cards MUST be mailed to the NFA Division within 10 business days of filing the application.

FILING AS A TRUST OR OTHER LEGAL ENTITY
In addition to providing the documentation of the existence of the trust or other legal entity, the applicant must electronically provide a photograph and completed ATF Form 5320.23, NFA Responsible Person Questionnaire (RPQ), for each responsible person (see definition 1.e on the instruction page) of the trust or legal entity. When filed via eForms, when in the Responsible Person function, the applicant will identify each responsible person and attach the photograph and a scanned, signed RPQ from that person. All photographs and RPQ forms must be attached to the application prior to submission.

The fingerprints for each responsible person must also be submitted. As for an individual applicant, the fingerprint cards must be sent to the NFA Division. The eForms system will email a cover sheet to the applicant listing the names of the responsible persons and is to be printed. The cover sheet and the fingerprint cards for all RP’s MUST be mailed in one batch to the NFA Division within 10 days of filing the application.

Please note that the F 5320.23, NFA RPQ, form is available in a fillable version on the ATF website (www.atf.gov). The form can be completed and printed for signature and scanning.

Yes.

It normally takes 1-3 weeks to get it from your examiners desk, to the mailroom, to your dealer.

I have not called personally, but the NFA reddit is swamped with people claiming they have. They are reporting that the NFA is only processing forms for government and police, regular Plebs form 4 and form 1 paperwork is not being processed during the shutdown. It's not "essential". Checks are still being cashed, of course. The money is handled by a local bank and isn't directly attached to the ATF in any real way.

I ordered 2 suppressors from TBAC back in the middle of January 2018. TBAC took 13 weeks to get the things sent to my local dealer (and they messed up my order to boot). Both checks were cashed May 4. The ATF had just started processing early May forms when the shutdown happened. I will be over 1 year from order to in hand for these. It's stupid.

Edit to add - people were generally reporting 236 to 244 days from check cashed to approved right before the gvt shutdown.

I just got off the phone with the Silencer Shop. They claim the ATF is dead in the water. I was going to purchase I can, but they didn't have exactly what I wanted in stock. I was going to compromise, but he talked me out of it since nothing is happening at ATF anyway.

ETA - Crap. I just checked. I placed my order on 1/11/18. 1 day short of 1 year to get these in hand. Ridiculous.

I emailed SilencerCO to see where I was for my BOGO suppressor and this is the response I received:


We are currently working on manufacturing these suppressors. We do have over 11,000 registrations to go through so it will take us longer than expected. However, I can confirm your registration and everything looks good. You are good to go on your end. We have started to ship these back in October and plan to continue shipping these out through the next couple months once the government shut down is over. The ATF is not currently processing forms. At this time we are unable to send cans out to dealers. However, once this ends, they will be shipping out in much larger batches.

I wasn't sure what to believe if they were still processing forms or not but I think this seals it. Build the damn wall already [Rant1][LOL]

The Machine Gun market is soft right now. Usually the people buying machine guns and sears are not new to the NFA process and much more patient than the average dude buying his first NFA item.

I'm feeling the same. I'm waiting on my very first NFA items and while I mostly don't think about it, I'm starting to get anxious. Just had checks cashed in November of last year and was hoping to get approved before hunting. Seems like the gov shut down allowed everything down enough that I don't think it's going to happen.

I'm seeing 2-3 week turn around on an Individual (Trust) F1 based on few forums. However you have 2-3 other people on that trust and you'll be in it for a few months +

Could have pulled employees from this duty or restricted overtime.

But this check and stamp issuance should be done at the dealer. The ATF does nothing more than a standard NICS check.

Form 4 to buy an NFA toy hasn't changed much other than some individuals starting to report very short (90 day?) returns. For whatever reason, trusts are still taking forever.

I can neither confirm or deny this as being truth but was told by someone, who picked up the phone at the ?wheres my stuff? line, they?re using a ?new? process on the individual submissions

Then they can print the stamp and then 10 minutes after submitting, you go home with your gun muffler or shorter rifle that is no more dangerous or concealable than a handgun... Then they can print the stamp and then 10 minutes after submitting, you go home with your gun muffler or shorter rifle that is no more dangerous or concealable than a handgun... They trust dealers for selling and running background check for far more "dangerous" guns.

We have had a couple May - June submissions come back in 3 months. Individuals though. Trusts are still 10-12 months.

I don't know whether the current administration as has done anything to reduce the BATFE backlog but it seems that now would be a good time to get orders in so they can be processed before next years election.

Congrats.

Looks like you were the beneficiary of the catch-up forms processing they were doing for Individuals until the whiners and letter writers effed it up.

This was the one time my usual lack of faith in anything the gov does was hopeful it was for efficiency and it would have helped clear out a lot of the backlog.

since the EFile process has a separate photo attachment process, is it still necessary to print/scan/attach a 2x2" photo to the 5320.23? OR Does the photo upload process negate the need for printing/scanning a photo and attaching it to the 5320.23?

I did not scan the 5320.23 with photo on my last submission (approved). You're required to upload the photo so it doesn't need to be on the RPQ.

There was an update direct from ATF, 90 days for research, and form 1's are climbing to 60 to 90 days for processing. If you look at the map of wait time by state, colorado is one of the states with the longest waits. No clue why unless they are still assigning processors to states and we just happen to have really really slow ones. I do know that all my stamps are either Ripley or what looks like Allen

I submitted an electronic Form 4 in April and don't have anything back yet.

I submitted two electronic Form 1's within a day of each other in May and they were approved months apart.

The ATF has no rhyme or reason. Completely random.

Are Lightning Fast NFA Transfers Here To Stay?

Many users are reporting approvals in a matter of days, or even HOURS! Will this trend continue?

The short answer appears to be YES! When it comes to suppressors, wait times suck! Since they were first regulated in 1934, delays associated with Form 4 processing have been a reality that the suppressor community has had to live with. For years, the American Suppressor Association has actively advocated for changes to the process to improve efficiencies and decrease delays. According to ATF, the months-long wait times we have unwillingly become accustomed to may be a thing of the past!


When it comes to suppressors, wait times suck!
Since they were first regulated in 1934, delays associated with Form 4 processing have been a reality that the suppressor community has had to live with. For years, the American Suppressor Association has actively advocated for changes to the process to improve efficiencies and decrease delays. According to ATF, the months-long wait times we have unwillingly become accustomed to may be a thing of the past!

At the end of 2023, the American Suppressor Association coordinated an Industry Roundtable with ATF to discuss problems and offer solutions to many of the underlying issues slowing down the eForms system. On March 15, 2024, the National Firearms Act Division hosted a webinar to discuss the processing improvements they have recently implemented. These improvements, many of which are a direct result of ASA?s Industry Roundtable with ATF, have helped dramatically speed up Form 4 transfers, bringing many approvals down to mere hours! While there is still tremendous variability in transfer times, ATF openly stated that the new and improved processing times are the ?new normal? and are expected to continue!

During the webinar, we learned a lot about the latest processes that ATF is employing to all but eliminate wait times. We?ve summarized the details into an FAQ so let?s dive into what we were told:

How is NFA Division currently processing forms?
In order to process an NFA application, ATF must first receive a response from the FBI National Instant Criminal Background Check System (NICS). The NFA Division currently submits NICS checks to the FBI in large batches. Rather than approving transfers sequentially based on date received, NFA examiners are now focusing on rapidly processing applications as soon as the NICS response has been received.

According to ATF, the ?NFA Division is processing eForm Individual applications in real-time? and will quickly do the same for Form 4s utilizing an NFA trust. Translated, this means that as soon as an approved NICS check is received by ATF, the NFA application is processed for final approval.

The NFA Division has established several ?swimlanes? where forms are funneled to examiners for processing to streamline the process further. These swim lanes are:

Individual Applications
Bundled Individual Applications
NFA Trust Applications
Bundled NFA Trust Applications
What is ?Bundling??
This is the term the NFA Division uses to identify an individual or trust with multiple pending applications in queue. These applications are for items purchased at the same time or over a period of time. When bundled, the NFA Division identifies these applications and packages them together so that a single NICS check can be submitted and all pending applications can be approved simultaneously. This reduces the overall number of background checks sent to FBI-NICS and allows NFA examiners to efficiently process multiple applications simultaneously.

What led to the rapid decrease in Form 4 processing times?
Changes in basic processing methods are responsible for the rapid decrease in Form 4 processing times. While paper forms will always be accepted, the NFA transfer process has been optimized to more efficiently process electronic applications. With roughly 96% of all NFA applications submitted electronically, this means more can be processed in a shorter period of time.

Perhaps the most impactful change is ATF?s departure from the ?First In, First Out? approach. Rather than waiting for applications to be approved sequentially, NFA now focuses on approving applications as soon as the applicant?s background check has received a NICS ?proceed?. Around 70% of background checks receive an instant ?proceed? from the FBI?s National Instant Criminal Background Check System (NICS). The remaining 30% are ?delayed? or ?denied?.

?Delayed? background checks require further investigation by the FBI-NICS team to ensure the applicant can legally procure a firearm. Delays are often resolved in a matter of moments, but with NFA applications, the delay can sometimes take months. That is because NFA items are not subject to the three business day statutory window outlined by the Brady Act. In other words, the FBI does not have to process delayed NICS checks for NFA items as quickly as they do for Title I guns (rifles, pistols, shotguns). It is important to note that NFA examiners do not process these background checks; the FBI does.

As of March 12, 2024, NFA has 77,963 open status background checks with NICS ? the oldest dating back to May 8, 2023. This is a leading cause for the wide range of approval times experienced by consumers.

Why did the NFA Division stop processing forms on a First In, First Out basis?

According to ATF, ?processing applications on a First In, First Out basis is untenable when FBI-NICS is an ?upstream supplier.?? To illustrate their point, ATF offered a grocery store express checkout lane analogy:

If five people are ready to pay by credit card and have only one item, each is stuck behind one person paying by check with a week?s worth of groceries and 20 coupons. It isn?t fair to hold up the five people that are ready to go.
?Fairness,? of course, is relative, especially for those with errors, complex trust issues, and/or background check delays. However, this new process moves the most significant number of applicants (70%) through the system in the most efficient manner so that examiners can then process delayed transfers more efficiently. This results in reduced transfer times across the board for all applicant types. There are also simple steps that applicants can take to avoid many of the common causes for delay.

How can I ensure my application is not delayed?
There is no single silver bullet to 100% ensure that your application is not delayed. However, if you take these steps, the likelihood of a delay is significantly lower:

Include your Social Security Number on your Form 4
Including your SSN reduces misidentification during background checks, especially for people with common names.
If you are frequently delayed when purchasing firearms, consider applying for a Unique Personal Identification Number (UPIN).
UPINs are assigned by the FBI to help applicants who experience frequent delays or wrongful denials quickly prove that they are not a prohibited person.
If you have a Unique Personal Identification Number (UPIN), include it.
What improvements are being made to expedite the processing of NFA trust applications?
The NFA Division is working to implement several improvements to the processing of trust applications that will all but eliminate the gap between individual and trust applicants. This will be especially true for applicants using ?standardized trusts? sold by reputable companies which have already been thoroughly vetted by ATF. Because they have been vetted, they require less manual review by examiners.

The NFA Division will also do away with the paper Responsible Person Questionnaire (RPQ) that must be completed by each Responsible Person (RP), scanned, and attached to trust applications. Instead, they will incorporate an electronic RPQ(s) as part of the eForms system. This will reduce common errors encountered with trust applications and reduce the workload on both the applicant and NFA.

How can I ensure the fastest approval using a trust?
Use a standardized trust from a reputable source
ATF has indicated that they are working to expedite the processing of applications using common NFA trusts.
Submit a responsible person questionnaire (RPQ) for each RP named in the trust
Every single RP. No exceptions.
Avoid submitting an invalid trust
For example: settlor, trustee, and beneficiary are the same person (merger doctrine).
Verify that the trust name listed on the trust documents matches the eForm application
If the name on your NFA Trust does not match the name on your NFA application, it will be delayed or denied.
Ensure that minors are not listed as responsible persons
Minors can?t serve as an RP ? no matter how responsible they may seem.
The more RP?s on a trust, the greater the chance of a delay
Even a single error or delayed NICS check for one RP will delay the entire approval.
Why are some consumers still waiting for an application to be approved when more recent applications are being approved so quickly?
Moving forward, the variability is most likely due to a delay in the NICS background check. As of March 12, 2024, the NFA Division was awaiting responses to 77,963 background check requests from NICS. The oldest outstanding check dates back to May 8, 2023.

The shift from one year and more wait times is a sea change, and especially surprising that it's happening during the Biden administration. It's an example of why I support the American Suppressor Association. They have successfully lobbied to open suppressor use for hunting in most states, and fought against efforts to ban suppressors in several states. When ASA formed in 2011, there were 285,000 legally obtained suppressors in circulation in the 39 states where they were legal to own. Today, there are over 3,150,000 suppressors in circulation. A mere 22 of these states allowed their use while hunting. Now, 44 states allow suppressors for hunting.

The ASA sponsored the Hearing Protection Act, which the Dems wouldn't allow out of committee for a vote. The ASA continues work toward removing suppressors from the NFA. All that's needed is a GOP executive with legislature and senate majorities. Oh, and a functional GOP at state and national levels.

There are about 5000 ASA members, but well over a million suppressor owners. The NRA and others have been AWOL in the suppressor revolution. This needs to change at the grassroots level of firearms owners.
