Javaad Marshall-Fields and his fiancee, Vivan Wolfe, were brutally gunned down in their car in June of 2005, before Fields could give his testimony. How is it that the myth of being able to purchase a gun on the internet without a background check is able to be repeated over and over in these hearings? And why isn't a single person taking their time to speak to explain that it is a blatant lie?

Waller just reported on Michael Browns show (630 KHOW) Biden is in town and talking to the Dem legislature to "hold the ground" and Colorado is ground zero.

Yep. And one of the sponsors couldn't answer questions because she was on the phone with Biden. Glad they're putting Colorado before party.

Is an FFL required to do one of these extended background checks? That is, can they refuse if they normally charge $25 and don't want to do a check for $10?

Rep. Gardner just introduced an amendment to not force FFLs to have to do these background checks for $10. Field objected!

Charging $10 to do a BGC is different than charging $20 to do a gun transfer. Usually what you see today is an FFL charging xxx$$$ for the transfer not for the BGC. BGC are free today so FFL's don't charge for them, that is the norm. So now if they force $10 for a BGC you will prob see $10 amount for BGC on top of xxx amount for gun transfer.

Singlestack
02-15-2013, 19:40
Correct - but here is the problem - the BGC for the transfer introduces some potential liability for the FFL. Although they get a thumbs up/thumbs down for the purchaser, they know nothing about a seller. Also, many FFLs may well not want to do a BGC for $10 as a hassle for them. If enough FFLs turn down these transfer BGCs, I fully expect the legislature to attempt to force them to do it. As Gardner said, in committee yesterday, several committee members thought that FFLs would be forced to do these. This may well be a motivation to not be an independent FFL.

Oh, so did I. He was just hearing what he wanted to hear. I think writing your senator will be requirement, since these are going to leave the house.

There will still be a vote that will be written down and counted. He will HAVE to abide by the written vote results. Not a bullshit audible vote.

Gotcha- good luck with forcing me or others to do a BCG. FFL's refuse, so now it becomes harder to find ones who do? I see an opportunity for a BGC clearing house.........

Bowtie
02-15-2013, 19:52
It will add extra cost to the FFL. They will have to collect and account for these fee's. There will be additional time for performing these actions. All of this will be passed on to the customer.

If the BG costs the FFL $10.50 why would we do the check for $10? I addition there's the cost of manpower to do the work. To force one to work without compensation is slavery. I think that would be a constitutional argument.

And what passes?

It passes second reading.

Nothing is a law yet. They will do third reading and vote next week. Then it will either fail or pass the House. That still doesn't make it a law yet... you then have to go to the Senate and do everything all over again. They'll have multiple readings and debate in the Senate. If they pass it there it technically still isn't a law yet. It will go to Hick's desk where he will have to sign it into law.

After all of that... if it gets that far (and that is likely)... your next recourse is lawsuits taking it to the state supreme court to (hopefully) overturn based on constitutionality.

You can but its technically illegal. There is no way it can be enforced. You can grind off the date stamps of pmags or deface magazines anyway you want, there is no law against it. It will simply be tacked on to charges if you commit a crime with it, to make it more illegal.
